用户协议 Terms of Service
第 1 条 协议主体与准入同意
1.1 本协议由OrientScan（运营主体：青岛沧海国际旅行社有限公司，下称 “我方 / 平台”）与访问、注册、下单购买本网站服务的自然人 / 法人用户（下称 “您”）缔结。网站域名：OrientScan.com 。
1.2 您点击 “同意协议”、注册账号、浏览网站、提交订单、支付款项任一行为，即代表您已完整阅读、充分理解并无条件接受本协议全部条款，自愿受本协议法律约束。若您为未成年人，必须由法定监护人代为确认同意并承担全部法律责任。
1.3 本协议项下所有服务合同签订地为山东省青岛市黄岛区。
第 2 条 平台服务内容
2.1 本平台为赴华跨境医疗旅行一站式中介服务平台，线上可下单订购：医疗预约对接、体检筛查（PET-MRI 等）、眼科诊疗、IVF 生殖辅助、术后康复、医疗签证协助、翻译陪同、住宿交通、行程规划等打包服务与单项商品服务。
2.2 我方仅为信息撮合、行程代办、资源对接服务商，不直接提供诊疗、开药、手术等医疗执业行为，所有医疗诊疗服务由国内具备合法资质的合作医疗机构独立提供，医疗诊疗风险由医疗机构依法承担，平台不承担医疗诊疗过错责任。
2.3 平台仅展示合作机构公开报价，最终成交价格以订单付款页面公示金额为准。
第 3 条 账号注册与用户义务
3.1 您注册账号须提供真实、有效身份信息、联系方式、国别地址；信息虚假造成订单无法履约、签证失败、行程损失，全部后果由您自行承担。
3.2 账号用户名、登录密码由您自行保管，因账号出借、泄露、被盗产生的订单消费、法律责任均由账号实名用户承担。
3.3 禁止利用本网站从事违法代购、虚假下单、恶意退款、造谣诽谤、爬虫抓取网站数据、侵犯平台知识产权等行为，我方有权直接封禁账号、撤销订单并追究赔偿。
第 4 条 线上订单、支付与履约规则
4.1 您提交订单并完成付款，视为双方网络服务买卖合同正式成立。订单一经生成具备合同效力。
4.2 付款支持网站公示的跨境支付渠道、对公转账；付款后我方开具对应凭证。
4.3 退改规则：
全款支付：
（1）行程未启动、未预约医院资源：可申请 7 日内全额退款，平台扣除 3% 手续服务费；
（2）已锁定医院号源、预约医生：仅可变更出行日期，不予全款退单，如需取消扣除订单总额 25% 资源违约金；
（3）医疗服务已实际开展（面诊、检查、手术），订单不可退改，不予退款。
定金支付：
（1）已锁定医院号源、预约医生：仅可变更出行日期，不予退款；

4.4 因您个人签证拒签、个人原因放弃来华、自身健康不符合诊疗条件导致无法履约，依照本条退改条款执行。
4.5 因合作医院停诊、政策不可抗力、公共卫生事件导致无法履约，平台可全额无手续费退款或免费延期行程。
第 5 条 知识产权约定
5.1 网站 LOGO、文字文案、图片排版、页面程序、商标「OrientScan」全部著作权、商标权归我方所有。
5.2 未经我方书面许可，任何单位、个人不得转载、复制、篡改、商用本网站全部内容，否则我方有权提起诉讼主张侵权赔偿。
第 6 条 免责与责任限制
6.1 平台仅做中介对接，不对医疗机构诊疗效果、治愈率、检查结果做任何承诺与担保，医疗相关风险由您与接诊医疗机构自行权责划分。
6.2 因地震、疫情、出入境管制、海关政策、外交政策、航班停运等不可抗力导致合同无法履行，双方互不承担违约责任，按退款 / 延期方案处理。
6.3 我方对您的间接损失、预期收益损失、商誉损失不承担任何赔偿责任；单订单最高赔付上限不超过该订单您实际支付总金额。
第 7 条 协议修改与终止
7.1 我方有权不定期修订本协议，修订后在网站法律页面公示即生效，不再单独逐一通知用户；您继续使用网站即视为接受新版协议。
7.2 您可随时申请注销账号终止服务；我方在您违规违约前提下可单方永久封禁账号、终止服务。
第 8 条 争议解决（强制锁定条款）
8.1 本协议订立地：中华人民共和国山东省青岛市黄岛区。
8.2 因本协议、订单交易、网站使用产生一切纠纷，双方先行友好协商；协商无法达成一致，任何一方均可向青岛市黄岛区人民法院提起诉讼，双方约定排除其他地域法院管辖。
8.3 本协议适用法律：中华人民共和国境内现行有效法律。

9.1 本协议与《隐私政策》共同构成完整用户使用合同，不可拆分。

Article 1 Acceptance & Contract Establishment
1.1 This Terms of Service is entered into between OrientScan (hereinafter referred to 青岛沧海国际旅行社有限公司 as "We/Platform") and any user who accesses, registers, places orders or purchases services via this official website. Website domain: OrientScan.com.
1.2 By checking "I Agree", registering an account, browsing the site, submitting orders or completing payment, you fully acknowledge, understand and unconditionally bind yourself to all clauses herein. Minors must obtain legal guardian’s consent before using the Platform.
1.3 This contract is formally concluded in Huangdao District, Qingdao City, Shandong Province, People’s Republic of China.
Article 2 Service Scope
2.1 The Platform provides one-stop concierge service for international medical travel to China, including online orderable items: hospital appointment arrangement, medical screening (PET-MRI etc.), ophthalmology treatment, IVF fertility assistance, rehabilitation care, medical visa support, interpreter service, accommodation & transportation, customized itinerary planning.
2.2 We only act as an information broker and service coordinator. We DO NOT provide any medical diagnosis, prescription or surgical treatment. All clinical services are independently delivered by qualified partner hospitals in China. We shall not be liable for any medical malpractice or clinical outcome from hospital treatment.
2.3 All prices displayed on the website are reference quotations; the final binding price is confirmed on the checkout payment page.
Article 3 Account & User Obligations
3.1 You must submit truthful, valid identity, contact and residential information during registration. Any loss or failed service caused by false information shall be borne solely by you.
3.2 You are fully responsible for keeping your account username and password confidential. All orders and liabilities arising from account leakage, sharing or theft shall be attributed to the registered account holder.
3.3 Any malicious order cancellation, data crawling, infringement or illegal activities are strictly prohibited. We reserve the right to suspend or terminate your account and claim compensation.
Article 4 Order, Payment & Cancellation Policy
4.1 An online sales contract takes effect immediately after you submit the order and complete full payment.
4.2 Payment can be made via authorized cross-border payment channels or bank transfer. Official receipt will be issued upon confirmation.
4.3 Refund & Modification Rules:
Full payment：
(1) Before itinerary arrangement and hospital booking: full refund available within 7 calendar days, with a 3% administrative service fee deducted.
(2) If hospital appointment or doctor resource is locked: only date rescheduling is allowed; full cancellation will forfeit 25% of total order amount as resource reservation penalty.
(3) Once medical consultation, examination or surgery has commenced, no refund or modification shall be accepted.
Deposit payment:
(1) Hospital appointment slots and doctors have been reserved: only the travel date can be changed, and no refunds will be provided;
(2) Medical services have been actually provided (consultation, examination, surgery), and the order is non-refundable and non-amendable. No refund will be issued.
4.4 Refusal of visa application or voluntary abandonment of China trip due to personal reasons shall follow above cancellation clauses.
4.5 Full fee refund without deduction or free itinerary postponement will be offered if service cannot be delivered due to hospital suspension, government policy or force majeure events.
Article 5 Intellectual Property
5.1 All trademarks, logos, webpage design, text, code and visual content on this website are protected by copyright and trademark law, owned exclusively by OrientScan.
5.2 No reproduction, distribution, editing or commercial use of website content is permitted without prior written authorization from our side; legal action will be taken against infringement.
Article 6 Disclaimer & Liability Cap
6.1 We issue no warranty or guarantee on medical treatment effect, cure rate or examination result. All medical risks shall be settled between you and the treating hospital.
6.2 Neither party shall be held liable for breach of contract if performance is prevented by force majeure including natural disasters, pandemic control, entry-exit policy adjustment, flight suspension or diplomatic restrictions.
6.3 We shall not compensate for indirect loss, loss of profit or reputational damage. The maximum total compensation payable by us shall never exceed the total amount you have paid for the specific order.
Article 7 Revision & Termination
7.1 We reserve the right to revise these Terms of Service. Updated version will be published on the legal page of website and take effect immediately without individual notification. Continued use of the website constitutes acceptance of revised terms.
7.2 You may apply for account cancellation at any time. We have the right to permanently block your account if you violate binding clauses.
Article 8 Dispute Resolution (Mandatory Clause)
8.1 Place of Contract Conclusion: Huangdao District, Qingdao City, Shandong Province, P.R.China.
8.2 Any dispute arising out of this agreement, online orders or website usage shall first be resolved through friendly negotiation. If negotiation fails, exclusive jurisdiction is granted to the People’s Court of Huangdao District, Qingdao City, China. All other judicial venues are excluded by mutual agreement.
8.3 Governing Law: Only the effective laws of the People’s Republic of China (Mainland).
Article 9 Miscellaneous
9.1 This Terms of Service together with the Privacy Policy constitute the complete binding agreement between both parties.
